Notice: This tool is to be used ONLY to contact IBP members for the purposes of engaging their services. It is NOT to be used to solicit IBP members, to send advertisements to them, to recruit them, etc... IBP staff screen submissions. A user who abuses this tool will be blocked from using it.

As a condition precedent to use of this Institute of Brownfield Professionals (IBP) referral service, the user of this service (User) expressly agrees to waive any claim against, and to indemnify, defend, and hold harmless from and against any claims or losses arising from User’s use of the IBP referral service, the IBP; the IBP’s officers, directors, committee chairs, committee members, and staff; and their agents, heirs and assigns.

By accepting these terms, User states that User understands that:

·        A LISTED INDIVIDUAL OR ORGANIZATION (PROVIDER) CLAIMING CERTAIN COMPETENCIES OR EXPERIENCE MAY NOT POSSESS THE COMPETENCIES AND EXPERIENCE CLAIMED BY SUCH PROVIDER;

·        the IBP takes what it considers to be reasonable measures to help verify that an individual possesses the competency and experience identified by the IBP as being necessary for an individual to be credentialed as a Registered Brownfield Professional (RBP), but the IBP’s measures are not failsafe;

·        the IBP takes no measures to evaluate the claims of individuals who are not credentialed as RBPs;

·        actual possession of certain competencies and experience is not a guarantee or warranty that a Provider will serve in a nonnegligent manner, or even that a Provider will not commit an act of intentional or gross negligence; and

·        investigating and evaluating a Provider’s background, experience, competencies, and capabilities before retaining a Provider is essential, and SUCH INVESTIGATION AND EVALUATION ARE THE RESPONSIBILITIES OF USER, NOT THE IBP.
